Purpose of the Agreement
Client wishes to hire Bloomsake LLC to provide services relating to Client's floral preservation as detailed in this Agreement. Bloomsake LLC has agreed to provide such services according to the terms of this Agreement.
TERMS
EXPECTATIONS PAGE AGREEMENT
By placing an order, the client acknowledges that they have read and reviewed the 'Expectations' page on our website and understands all the different factors that come with resin floral preservation.
FLORAL CONDITIONS
Bloomsake LLC cannot guarantee the freshness of Client's flowers during the shipping process. Clients must not expect flowers to look perfect if shipped or dropped off more than 3 days past the event date. Bloomsake LLC will still work with the flowers received but cannot guarantee the freshness of the flowers due to timing. If Client's flowers are too damaged to work with, Bloomsake LLC will reach out to the Client.
FLORAL COLOR CHANGES
Client understands that when it comes to preserving flowers, all flowers will go through a dehydration/drying process to be encased in resin. Fresh flowers will rot when encased in resin. Bruising (transparent spots) on petals can occur, especially on lighter flowers. Resin may amber over time if exposed to direct sunlight or heat. For pressed frames, all flowers will be dried using a press technique. Some color changes may occur during both drying processes. For example, red, dark pink and purple tones will turn darker into shades of burgundy and white colors will turn into a creamy hue. This is most common in roses.
DESIGN
Client acknowledges that the preservation process involves customization. Not all flowers can be used due to drying limitations. Clients will receive one complimentary design preview for main pieces only before resin is poured. Smaller pieces such as initial blocks, ring holders, ornaments, accessories holders, etc.Changes to the design must be approved within 3 days; otherwise, Bloomsake LLC will proceed with the design preview.
ARTWORK QUALITY
Clients acknowledge that every piece is handmade and minor imperfections may occur due to the nature of the resin medium. Bubbles, lines, or slight visibility of flowers may be present on pieces. Such imperfections will not affect the flowers' quality.
PRODUCTION TIME
The production period from start to finish is approximately 6 months, with variations possible during busy periods or for larger orders.
SHIPPING AND HANDLING
Bloomsake LLC is not responsible for mishandling of the floral package during shipping. Clients are responsible for the shipping of their flowers, including damages or lost packages. After shipping, Clients must email tracking information to Bloomsake LLC.
REFUNDS OR EXCHANGES
Due to the handmade and custom nature of each item, no exchanges or refunds are available.
STYLE RELEASE
Client understands that Bloomsake LLC's services are subjective, and results may vary. Bloomsake LLC will use personal judgment to create favorable results. A design preview is offered for main keepsake items. Smaller keepsake items do not have a design preview option.
LIMIT OF LIABILITY
Client agrees that the maximum amount of damages she is entitled to in any claim relating to this Agreement or Services provided herein shall not exceed Bloomsake LLC's total cost as set forth in this Agreement.
NON-DISPARAGEMENT
Both Parties agree not to make public defamatory statements that would materially harm the reputation or business activities of any Parties to this Agreement.
CLIENT DESIRES TO CANCEL OR RESCHEDULE
Clients can only cancel their order if we have not started drying or pressing their flowers.
NO-SHOWS
If it becomes impossible for Bloomsake LLC to render Services due to the fault of the Client or related parties, Bloomsake LLC may allow additional time for Services, and any paid amount is non-refundable
SEVERABILITY
If any portion of this Agreement is deemed illegal or unenforceable, the remaining provisions remain in full force if the essential provisions for each party remain legal and enforceable.
CLIENT RESPONSIBILITY FOR PRESERVED PIECES
Clients acknowledge that once they leave with their preserved piece, they are solely responsible for its care and condition. Bloomsake is not responsible for any damage or issues that occur after the piece is in the client's possession.
ORDER PICK-UP AND STORAGE
Clients must pick up their order within 2 months of being contacted by Bloomsake for pick-up. Bloomsake will make up to three contact attempts, via email and phone. If the order is not picked up within 2 months, Bloomsake will charge a $20 storage fee per month until the order is retrieved.
